ASTM product chemical requirements
1. PRODUCT CONSISTENCY AND SAFETY.
a) Seller shall fully disclose in writing to AFI all chemicals, materials, or raw materials that are in the Products that may be considered hazardous, are regulated in jurisdictions where the Product will be sold, or are listed by any of the following agencies or legislation as harmful to human health: International Agency for Research on Cancer (IARC), the United States Occupational Safety and Health Agency (OSHA), in the European Union System on Registration, Evaluation, Authorisation and Restrictions of Chemicals (REACH) list of Substances of Very High Concern (SVHC), United States National Toxicology Program, California Proposition 65, American Conference of Industrial Hygienists (ACGIH), or similarly recognized organizations.
2. ENVIRONMENTAL, HEALTH & SAFETY. Each Product complies with the following raw materials use requirements:
a) All Products must comply with the California Air Resource Board (“CARB”) Airborne Toxic Control Measure to Reduce Formaldehyde Emissions from Composite Wood Products, Title 17, California Code of Regulations, § 93120 (“CARB ATCM”). Seller must provide written documentation of Seller’s compliance with the CARB ATCM which shall include a copy of the current verification from a CARB-approved third party certifier indicating that the Products comply with the CARB ATCM. The duty to provide written documentation of Seller’s compliance with the CARB ATCM is a continuing duty and Seller must provide AFI with a copy of the third party certification each time the CARB-approved third party certifier verifies compliance.
b) No Products or component materials of the Products, including recycled content, or product samples will be introduced/produced using lead, cadmium, mercury, or chromium VI as an intentionally added component. Residual levels shall not exceed a total concentration of 100 ppm; 50 ppm for each individual metal. The Action Level* for residual levels of these metals will be >/=50 ppm total concentration or >/= 50 ppm for each individual metal. Concentrations of lead, cadmium, chromium VI and mercury shall be measured by a certified laboratory using a test method that is: (1) based on total content of the metal (vs. leachability / extraction), (2) that is appropriate for the matrix being tested and (3) is consistent with test method referenced by the relevant authority of the region where the product will be sold (i.e. US EPA, EU ECHA, etc.)
c) No Products or component materials of the Products shall have TBT (tributyl tin) at levels > 0.01% (100 ppm). The Action Level* for residual levels of TBT in Products or component materials of the Products will be >/=0.005% (50 ppm).
d) No Products or component materials of the Products shall have pentaerythritol, betadiketone, bisphenol A, or BHT (2, 6-Di-t-butyl-p-cresol or butylated hydroxy toluene).
e) The Products shall contain no asbestos or PCB’s.
f) No Products or component materials of the Products shall contain intentionally added Ortho-Phthalates-chemicals produced from aromatic petroleum distillates (starting with ortho-xylene oxidation to ortho-phthallic anhydride) (“OP”) OP includes but is not limited to the following:
· DEHP/DOP - di (2-ethylhexyl) phthalate - CAS 117-81-7
· DnHP - Di-n-hexyl phthalate – CAS 84-75-3
· DBP - dibutyl phthalate – CAS 84-74-2
· BBP - butyl benzyl phthalate – CAS 85-68-7
· DINP - Diisononyl phthalate – CAS 28553-12-0 & 68515-48-0
Residual levels of OP in any Product or component material of any Product shall not exceed a total concentration of 50 ppm (0.005%).The Action Level* for residual levels is any detectable OP concentration in a Product or component material of a Product.
Ø COMPLIANCE:
This material complies with the following raw materials use requirements:
· Environmental Health & Safety (EH&S)
· No raw material (including recycled content), finished product, or product samples will be introduced/produced using lead, cadmium, mercury, or chromium VI as an intentionally added component. Residual levels shall not exceed a total concentration of 100 ppm. The Action Level* for residual levels of these metals will be >/=50 ppm total concentration or >/= 50 ppm for each individual metal.
The material shall not contain Ortho-Phthalates (OP) at levels > 0.005% (50 ppm). The Action Level* for residual levels of OPs in an incoming raw material or finished product is any detectable OP concentration. The post-consumer recycled VCT content utilized in VCT is exempt from this requirement, with the exception of DEHP.
· The material shall not have TBT (tributyl tin, CAS # 688-73-3) at levels > 0.01% (100 ppm). The Action Level* for residual levels of TBT in an incoming raw material or finished product will be >/=0.005% (50 ppm).
· The material shall contain no asbestos, PCB’s, Bisphenol A (CAS # 80-05-7), or pentaerythritol** (CAS # 115-77-5).
